9 Certain students not counted In determining any roll or special education list, no account may be taken of any foreign student (within the meaning of section 2(1) of the Act)--- (a) who is not a student of a kind or description exempted (under a notice under section 4C of the Act having effect in 2004) from the payment of all the amount required by section 4B of the Act to be paid; or (b) in respect of whom all the amount required by section 4B of the Act to be paid has been or is to be paid by the Ministry of Foreign Affairs and Trade.
