74 Further provisions relating to transitional arrangements

(Regulation)



   74. Further provisions relating to transitional arrangements---(1) For
 the avoidance of doubt,---
   (a) On the expiry of the transition period, authorities may be given
         under section 29 of the Act, and directions may be made under
         section 32 of the Act, only in respect of programmes that have
         approved in accordance with Part III of these regulations and
         are provided by programme providers that have been so approved:
   (b) Nothing in regulation 73 of these regulations applies in respect
         of the authorisation of the provision of programmes to children:

   (c) Nothing in regulation 73 of these regulations prevents the giving
         of any authority under section 29 of the Act, or the making of
         any direction under section 32 of the Act, in respect of a
         programme that has been approved in accordance with Part III of
         these regulations and is provided by a programme provider that
         has been so approved.

   (2) Where,---
   (a) During the transition period, any person who is an existing
         programme provider applies under Part III of these regulations
         for approval as a programme provider; and
   (b) That application is declined,---

 then, from the date on which the decision declining that application is
 communicated to that person, that person ceases to be an existing
 programme provider in respect of programmes provided to the client group
 to which the application related.
