and (b) specify, and provide for the specification of, the requirements; and (c) prohibit nurse practitioners who fail to comply with the requirements from prescribing the medicines; and (d) make contraventions of that prohibition an offence. <<<>>> REG : Medicines (Designated Prescriber: Nurse Practitioners) Regulations 2005 PART : Regulations SECTI : Interpretation SECTNO : 4 TYPE : Clause YEAR : 2005 COMDATE : DD-MMM-YYYY TEXT : 4 Interpretation In these regulations, unless the context otherwise requires,--- Act means the Medicines Act 1981 nurse practitioner means, in so far as he or she is practising the profession of nursing, a health practitioner who--- (a) is, or is deemed to be, registered with the Nursing Council as a practitioner of the profession of nursing (whether or not he or she is, or is deemed to be, registered with another authority established or continued by the Health Practitioners Competence Assurance Act 2003 as a practitioner of, and is practising, another health profession); and (b) is permitted to practise within the scope of practice for a nurse practitioner nurse practitioner medicine--- (a) means a substance listed in the Schedule and that is declared to be a prescription medicine by regulations under the Act or by a notice given under section 106 of the Act; but (b) if the substance is declared to be a prescription medicine only in 1 or more specified forms or only for 1 or more specified purposes, does not include the substance in other forms or for other purposes Nursing Council means the Nursing Council of New Zealand continued by section 114(1)(a) of the Health Practitioners Competence Assurance Act 2003. <<<>>> REG : Medicines (Designated Prescriber: Nurse Practitioners) Regulations 2005 PART : Regulations SECTI : Authority to prescribe nurse practitioner medicines SECTNO : 5 TYPE : Clause YEAR : 2005 COMDATE : DD-MMM-YYYY TEXT : 5 Authority to prescribe nurse practitioner medicines A nurse practitioner may prescribe a nurse practitioner medicine if he or she meets--- (a) the requirements in regulation 6 for commencing for the first time to prescribe the medicine; and (b) undertaken the training (if any) that is specified for the purposes of this paragraph by the Nursing Council by notice in the Gazette; and (c) demonstrated, to the satisfaction of the Nursing Council, that he or she is sufficiently knowledgeable to safely prescribe all nurse practitioner medicines. <<<>>> REG : Medicines (Designated Prescriber: Nurse Practitioners) Regulations 2005 PART : Regulations SECTI : Other training to be undertaken SECTNO : 7 TYPE : Clause YEAR : 2005 COMDATE : DD-MMM-YYYY TEXT : 7 Other training to be undertaken To prescribe a nurse practitioner medicine, a nurse practitioner must have--- (a) undertaken successfully the training (if any) that is specified for the purposes of this regulation by the Nursing Council by notice in the Gazette; and (b) done so within the periods, or at the times, specified for the purpose in the notice, if the training is of an ongoing nature. <<<>>> REG : Medicines (Designated Prescriber: Nurse Practitioners) Regulations 2005 PART : Regulations SECTI : Assessments of competence to be completed SECTNO : 8 TYPE : Clause YEAR : 2005 COMDATE : DD-MMM-YYYY TEXT : 8 Assessments of competence to be completed To prescribe a nurse practitioner medicine, a nurse practitioner must have--- (a) completed successfully the assessment (if any) of competence to prescribe the medicine that is specified for the purposes of this regulation by the Nursing Council by notice in the Gazette; and (b) done so within the periods, or at the times, specified for the purpose in the notice, if the assessment is to be completed at regular intervals. <<<>>> REG : Medicines (Designated Prescriber: Nurse Practitioners) Regulations 2005 PART : Regulations SECTI : Gazette notices SECTNO : 9 TYPE : Clause YEAR : 2005 COMDATE : DD-MMM-YYYY TEXT : 9 Gazette notices (1) For the purposes of these regulations, a notice in the Gazette--- (a) comes into force on the 28th day after the date of publication or on a later date specified for the purpose in the notice; and (b) may provide that it expires, if not sooner revoked, with the close of a specified day. (2) Within 5 working days after the date of publication of a notice in the Gazette for the purposes of these regulations, and while the notice remains in force, the Nursing Council must ensure that an up-to-date version of the notice is--- (a) available on the Internet; and (b) available at the office of the Nursing Council during business hours, so that members of the public may--- (i) inspect the notice free of charge; or (ii) obtain a photocopy of the notice for a reasonable fee. <<<>>> REG : Medicines (Designated Prescriber: Nurse Practitioners) Regulations 2005 PART : Regulations SECTI : Prohibition on prescribing without meeting requirement SECTNO : 10 TYPE : Clause YEAR : 2005 COMDATE : DD-MMM-YYYY TEXT : 10 Prohibition on prescribing without meeting requirement (1) A nurse practitioner must not prescribe a nurse practitioner medicine if he or she fails to comply with a requirement in regulation 6, 7, or 8 relating to the medicine. (2) A person commits an offence if he or she contravenes or fails to comply with subclause (1). (2) The Medicines Regulations 1984 are consequentially amended by--- (a) revoking regulation 3(1A) and (1B) and Parts 1A and 1B of Schedule 1; and (b) inserting in regulation 64(1)(a), after the expression "39(5),", the expression "39(7),"; and (c) inserting in Schedule 1, after the Part 1 heading, the following note: "Amending or replacing this Part may affect designated prescriber regulations under section 105(1)(q) of the Act." <<<>>> REG : Medicines (Designated Prescriber: Nurse Practitioners) Regulations 2005 PART : Regulations SECTI : Saving for existing designated prescriber nurses SECTNO : 13 TYPE : Clause YEAR : 2005 COMDATE : DD-MMM-YYYY TEXT : 13 Saving for existing designated prescriber nurses (1) An existing designated prescriber nurse must, during the 3 years beginning with 1 November 2005, and despite the revocations effected by regulation 12, be treated as authorised by the former regulations to prescribe a specified prescription medicine if the nurse meets the requirements in the former regulations, and those imposed by the Nursing Council under those regulations before their revocation,--- (a) for commencing for the first time to prescribe the medicine; and (b) (if relevant) for prescribing the medicine. (2) In this regulation,--- existing designated prescriber nurse means a person who, immediately before 1 November 2005, was authorised by the former regulations to prescribe a specified prescription medicine former regulations means the regulations revoked by regulation 12(1) specified prescription medicine means a prescription medicine specified in Part 1A or Part 1B of Schedule 1 of the Medicines Regulations 1984 (as those Parts existed immediately before 1 November 2005). (3) Nothing in this regulation prevents an existing designated prescriber nurse from becoming, during the period specified in subclause (1), a nurse practitioner authorised by these regulations to DD-MMM-YYYY TEXT : Explanatory Note This note is not part of the regulations, but is intended to indicate their general effect. These regulations come into force on 1 November 2005. They authorise nurse practitioners registered with the Nursing Council of New Zealand to prescribe certain prescription medicines if the nurse practitioners meet certain requirements relating to competence, qualifications, and training. The details of most of those requirements will be specified by the Council by notice in the Gazette. Nurse practitioners who do not meet those requirements--- o must not prescribe prescription medicines; and o commit an offence if they do. These regulations also--- o amend the Medicines Regulations 1984 so that they prohibit prescribing of prescription medicines by authorised nurse practitioners for use outside, or contrary to a condition stated in, their personal scopes of practice determined by the Council under the Health Practitioners Competence Assurance Act 2003; and o revoke and replace the Medicines (Designated Prescriber: Nurses Practising in Aged Care and Child Family Health) Regulations 2001; and o make consequential amendments to the Medicines Regulations 1984; and o continue, for a 3-year transitional period, and if those nurses meet specified requirements, existing designated prescriber nurses' authority under the revoked regulations to prescribe specified prescription medicines. Designated prescriber nurses are also authorised, in certain circumstances, to prescribe certain controlled drugs: see section 8(2A)(a) of the Misuse of Drugs Act 1975 and regulations 12A and 21(4B) of the Misuse of Drugs Regulations 1977. (Those regulations also regulate the issue by those nurses of prescriptions for the supply of controlled drugs.) Issued under the authority of the Acts and Regulations Publication Act 1989.
