19B
All other civil proceedings to be tried before Judge alone, unless Court otherwise orders
[19B. All other civil proceedings to be tried before Judge alone,
unless Court otherwise orders---(1) Except as provided in section 19A of
this Act, [[civil proceedings]] shall be tried before a Judge alone.
(2) Notwithstanding subsection (1) of this section, if it appears to
the Court at the trial, or to a Judge before the trial, that the [[civil
proceedings]] or any issue therein can be tried more conveniently before
a Judge with a jury the Court or Judge may order that the [[civil
proceedings]] or issue be so tried.]
Ss 19A and 19B were inserted by s. 9 (1) of the Judicature
Amendment Act 1977.
In subs. (1) of s. 19B the words ``civil proceedings'' were
substituted for the words ``every action'' by s. 11 (1) of the
Judicature Amendment Act (No. 2) 1985.
In subs. (2) of s. 19B the words ``civil proceedings'', in both
places where they appear, were substituted for the word ``action''
by s. 11 (1) of the Judicature Amendment Act (No. 2) 1985.
