53. Right of recovery in certain cases---(1) The costs incurred by a
Fire Authority or apportioned to a Fire Authority under this Act in
relation to the control, restriction, suppression, or extinction of any
fire shall be deemed to be loss suffered as a result of the fire, and,
if the circumstances relating to the origin of the fire or the spread
thereof are such that any person who suffers loss as a result of the
fire has a right of action for damages in respect of that loss against
any other person, then the Fire Authority or any owner or other
landholder on whom any portion of those costs are levied pursuant to
this Act shall have a right of action for damages against that other
person for the amount of the costs or the portion thereof levied as
aforesaid.
(2) If any person makes default in the payment of any money payable by
him to a Fire Authority under this Act, the amount thereof shall be
recoverable from that person as a debt due to the Fire Authority.
