43. Additional matters to be considered when application made for
 developing new organisms in containment---The Authority, in making a
 decision under section 45 of this Act, on an application made under
 section 40 (1) (b) of this Act, shall have regard to---
   (a) The matters set out in regulations made under section 41 of this
         Act; and
   (b) The matters in section 37 of this Act.
