5. Rules relating to safety and licensing---Without limiting the power
conferred by section 4 of this Act, in the interests of safety within
the land transport sector, the Minister may make all or any of the
following ordinary rules:
(a) Rules regulating the use or special use of any road or roads
(including, but not limited to, the use of vehicles and other
things affecting roads, and the movement of animals on or across
any road), or prohibiting or restricting any such use of any
road or roads:
(b) Rules prescribing requirements or making provision in respect of
the construction, maintenance, improvement, and use of equipment
and facilities used for the purpose of road transport, including
(but not limited to) rules providing for the following:
(i) The provision of traffic control devices:
(ii) The prevention of interference with traffic control
devices and other road transport facilities:
(c) General operating rules and rules regulating or relating to road
user behaviour, including (but not limited to) rules specifying
the following:
(i) The conditions under which vehicles may be used or any act
may be performed in or on or from vehicles:
(ii) The conditions under which individuals may use roads:
(iii) The maximum speeds or minimum speeds or both of vehicles
or of specified classes of vehicles---
(A) On any road or on roads of any specified classes; or
(B) In any locality or throughout New Zealand:
(d) Rules providing for the control of things likely to be hazardous
to land transport safety, including (but not limited to) rules
providing for the following:
(i) The safe carriage of dangerous or hazardous goods or
substances by land transport:
(ii) The construction or use of any thing likely to be
hazardous to land transport safety:
(e) Rules specifying standards in respect of the construction of
vehicles, the equipment to be carried on vehicles, the mass and
dimensions of vehicles, vehicle emissions, the environmental
requirements of vehicles, the loading requirements of vehicles,
the identification of vehicles, the repair of vehicles, the
maintenance of vehicles, the modification of vehicles, the
inspection of vehicles, and the fuel systems of vehicles,
including (but not limited to) rules providing for the
following:
(i) Requiring the design plans and chassis manufacturer's
specifications to be made available for inspection before
construction or importation, as a condition of the grant of an
approval:
(ii) Limiting or prohibiting vehicle noise and vehicle
emissions:
(iii) Other environmental restrictions on vehicles:
(iv) Specifications for alternative fuel systems:
(f) Rules specifying driver responsibilities, including (but not
limited to) rules providing for the following:
(i) The use of vehicle safety equipment by the occupants of
vehicles:
(ii) Limiting driving hours and hours on duty for drivers of
heavy goods vehicles or drivers of vehicles operated under a
transport service licence:
(iii) Compliance with restrictions in respect of hazardous
goods or loading:
(iv) Prohibiting the use of vehicles that do not comply with
construction, registration, licensing, equipment, or inspection
requirements:
(g) Rules specifying the responsibilities of vehicle owners, including
(but not limited to) rules providing for the following:
(i) Requiring owners to maintain vehicles to approved
standards of maintenance and to meet emission, environmental,
and equipment requirements:
(ii) Imposing prohibitions on the use, by owners or by persons
authorised by owners, of vehicles that do not comply with
construction, registration, licensing, equipment, or inspection
requirements:
(h) Rules specifying the responsibilities and behaviour of transport
service operators, including (but not limited to) rules
providing for the following:
(i) The obligations and restrictions in respect of signs on
vehicles:
(ii) The fixing and advertising of fares, complaints
procedures, and the recording of complaints:
(iii) The maintenance of a register of tows and hires:
(iv) The obligations of rental service operators:
(i) Rules specifying the performance requirements of law enforcement
devices and measuring devices, including (but not limited to)---
(i) The approval of breath testing devices, vehicle
surveillance devices, speed measuring devices, brake testing
devices, emission measuring devices, and vehicle weighing
devices:
(ii) The classification, approval, and use of recording
devices:
(j) Rules exempting any specified person or persons of a specified
class from the requirement to hold any licence:
(k) Rules prohibiting the use of a vehicle if a current licence is not
held in respect of that vehicle or the owner or operator does
not hold a current appropriate licence.
