5. Fencing covenants and agreements registrable---(1) Fencing
 covenants and fencing agreements relating to land subject to the Land
 Transfer Act 1952 may be registered under that Act against the title to
 that land.

   (2) Subject to section 6 of this Act, the burden of any fencing
 covenant or fencing agreement that is registered against the title to
 the land to which it relates shall run with the land, whether or not
 assigns are named in the covenant or agreement.
